Warranty Policy

EFILIVE LIMITED’S WARRANTY OBLIGATIONS ARE LIMITED TO THE TERMS SET FORTH BELOW.

EFILive Limited ("EFILive") warrants to the original consumer purchaser (“you” or “your”) that new EFILive AutoCal and FlashScan devices, connectors and cables (“Products”) will be free from defects in materials and workmanship for a period of twelve calendar months from the date of purchase. The start of the warranty period is the documented date of your purchase of the Product. Your receipt shows the documented date of your purchase. The warranty herein, and any implied warranties that may exist under local law are non-transferable.

Please note that EFILive reserves the right to update, from time to time, these warranty terms and to establish the effective date of the updated warranty terms. Please refer to www.efilive.com for the current Warranty Policy for EFILive products.

To determine if there is a Product defect and if necessary, to obtain a Return Merchandize Authorization (“RMA”) number required for warranty service, you must first complete the EFILive Warranty and Repair Process, located at the EFILive website home page under the “Support” menu, then the “Documentation/Tutorials” menu, or click here.

If you discover a defect in material or workmanship in your Product(s) during the warranty period and you have completed the steps outlined in the EFILive Warranty and Repair Process and EFILive confirms the defect exists, EFILive will at its sole discretion repair or replace the defective Product(s) at no charge to you, or refund the purchase price provided that the Product(s) are returned during the warranty period, with transportation costs prepaid to the service facility designated by EFILive. The Product(s) must be properly packaged by you with the RMA number clearly displayed on the outside of the packaging.

EFILive may require a copy of the receipt or a bill of sale stating the purchaser's name, EFILive product name, date and location of purchase of the Product(s) for which the defect has been reported as proof of purchase for warranty service or prior to issuing any replacement Product(s).

If EFILive elects to repair any Product(s), EFILive shall own all parts removed from the repaired Product(s). Repair parts or replacement Product(s) may, at EFILive’s option, include equal or better parts or Product(s)

The warranty period on replacement Product(s) is the remainder of the warranty on the original Product(s) or thirty (30) calendar days, whichever is longer.

EFILive’s Authorized Service Centers shall have thirty calendar days from the date of proper receipt of alleged defective Product(s) as described above, to repair or replace the defective Product(s) or refund the purchase price excluding any shipping and handling charges, as allowed per jurisdiction. EFILive shall make a reasonable effort to provide a diagnosis of the defective Product(s) to you, within five calendar days of proper receipt of the Product(s).

This warranty applies only to the Product(s) that can be identified by the original, unaltered EFILive trademark, trade name or logo affixed to them. EFILive does not warrant any Product(s) that are not manufactured by, or under contract with EFILive.

This warranty does not cover any loss or damage, monetary or otherwise, to any Product(s) with unauthorized modifications or attempted modifications.

This warranty does not cover any loss or damage, monetary or otherwise, caused by misuse or other external conditions including but not limited to the following:

  • Damage caused by unauthorized parties attempting to investigate, diagnose, modify or repair the device;
  • Abuse, mistreatment, neglect or negligence;
  • Defect of, or incorrect connection of, other devices to the Product(s), or around the Product(s);
  • Incorrect connection of power supply, including the use of power inverters;
  • Damage caused by any significant physical or electrical stress or excessive power fluctuation;
  • Damage caused by modification or repair not made or authorized by EFILive;
  • Product(s) that are determined to be stolen.

THIS WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE, NON-TRANSFERABLE AND SUPERCEDE ALL OTHERS, WHETHER ORAL OR WRITTEN, EXPRESSED OR IMPLIED. EFILIVE SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES AS TO THE PRODUCT(S) OR ANY OTHER MATTER WHATSOEVER. IN PARTICULAR, BUT WITHOUT LIMITATION, EFILIVE SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES OR CONDITIONS OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS OR ANY OTHER WARRANTY ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.

No EFILive distributor, reseller, dealer, agent or employee is authorized to make any modification, extension or addition to this warranty.

EFILIVE IS NOT RESPONSIBLE FOR SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES HOWEVER CAUSED AND WHETHER OR NOT EFILIVE WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF DATA OR PROGRAMS, LOST PROFITS, DOWNTIME, GOODWILL, DAMAGE OR REPLACEMENT OF EQUIPMENT AND PROPERTY, AND ANY COSTS OF RECOVERY.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages or exclusions of implied warranties, so the above limitations or exclusions may not apply to you.
